Agreement

Please carefully read the following Terms of Use (“Terms”) before using the Irelia Health website (“Website”). If you do not agree with these terms, you will not be able to use the Irelia Health website and the services provided by Irelia Health.

Binding Agreement

This is a contract between you (“User”) and Irelia Health, a Turkish company located at Kuştepe, Mecidiyeköy Yolu Cd. No:12, 34381 Şişli/İstanbul. The services offered on the Website are provided by Irelia Health.

Any individual or legal entity that accesses the Website, whether through a paid subscription (“premium subscription”) or free access (“standard subscription”), is deemed to have accepted these Terms.

Irelia Health, as the Website owner, reserves the right to change any information, forms, content, Website, and Terms without prior notice to users. Such changes will be effective as of the date they are published on the Website. Any individual or legal entity using the Website services or accessing the Website will be deemed to have accepted these changes in advance.

These Terms of Use were published and became effective on 13/07/2024 on the Irelia Health website. These Terms of Use are an integral part of any agreement made or to be made with users and business partners of Irelia Health.

Definitions

Application
The mobile application providing various services and content within the framework set by Irelia Health, accessible online.

Confidential Information
Any information, whether written, verbal, or expressed electronically, or otherwise disclosed, which can be tangible or intangible.

​

Participant
Any individual who participates in and responds to surveys conducted by Irelia Health.

​

User
Any individual, legal entity, association, public institution, or organization that can access the services and offerings provided by Irelia Health.

Link
A connection enabling access to another website, files, or content from the Application or Website, or access to the Application or Website, files, and content from another website.

​

Content
Any information, survey, file, image, photo, sound, price, all visual, literary, and auditory images published or accessible from the Irelia Health Application or Website.

Website
The online platform accessible from the address https://ireliahealth.com/ where various services and content are provided within the framework set by Irelia Health.

VIP Treatment

  • Irelia Health is completely free to determine which services and content accessible on the Website are subject to a fee.
    Those who benefit from the services provided by Irelia Health and those who use the site can only carry out transactions on the Website for lawful and personal purposes.
     

  • The legal and criminal responsibilities for all actions and transactions performed by users on the Website are entirely their own; Turkey is not liable for users’ actions.
     

  • Each user agrees not to engage in any action or transaction that would infringe on the rights of Irelia Health or any third party; not to disclose written, visual, and auditory information; and acknowledges that Irelia Health is the exclusive owner of any information disclosed at the time of disclosure, including its use, processing, storage, disclosure, and disclosure to third parties.
     

  • Users agree and undertake not to reproduce, copy, distribute, or process images, texts, visual and auditory images, video clips, files, databases, catalogs, and lists found on the Website or enter into direct or indirect competition with Irelia Health through these actions or other means. Users agree to protect and preserve all information obtained or learned due to these Terms.
    Users will not use any written, verbal, or electronic confidential information obtained during the execution of these Terms for any purpose other than fulfilling these Terms, and will not disclose it to any third party or organization. If any confidential information is disclosed to a third party due to the negligence of the user, the disclosing party will be responsible for any direct or indirect damages or losses incurred. Users’ obligations regarding the protection of confidential information will continue for 5 years after these Terms end.
     

  • Irelia Health is not responsible for the services and content provided by third parties, even if they are accessible from the Website. The accuracy and legality of information, content, visual, and auditory images published by any third party are entirely the responsibility of those third parties.
     

  • Irelia Health does not guarantee or warrant the security, accuracy, or legality of services and content provided by third parties.
     

  • Irelia Health is not responsible for verifying the accuracy of information and content provided by users or uploaded, changed, and provided by them through the Website. Users agree and undertake that the information and content they provide through the Website is accurate and lawful.
     

  • Users agree not to engage in activities that would constitute unfair competition under the Turkish Commercial Code, or infringe upon the personal and commercial reputation of Irelia Health or third parties.
     

  • Irelia Health may provide links to other websites, files, or content controlled by third parties. These links are provided solely for reference convenience and do not imply endorsement of the websites, their operators, or their content. Irelia Health is not responsible for the websites, files, or content accessed via these links, or the services or products provided through these websites.
     

  • Irelia Health may use the information provided by users in accordance with the Privacy Policy and other agreements made with users and third parties. This information may be processed, classified, and stored in a database. Irelia Health may also use information about the user’s or visitor’s identity, address, email, phone, IP address, Website activity, browser type, date, and time for statistical evaluations and personalized services in accordance with agreements made with users and third parties.
     

  • Specific and/or supplementary terms and conditions may apply to certain products, content, programs, or other activities, including points, gifts, promotional items, discount coupons, and any other awards or services earned by participants through surveys. These terms and conditions will be specified, and participants will be subject to them.
     

  • If participants choose to donate their earned award amount, the awarded amount will be donated by Irelia Health on behalf of the participants to the specified organization.
     

  • The earned award amount cannot be divided into multiple coupons or used in different ways

Intellectual Property Rights

  • All elements of the Website (including but not limited to design, text, images, HTML code, and other codes) are either owned by Irelia Health or used under a license from a third party.
     

  • Users do not have the right to resell, process, share, distribute, display, or reproduce Irelia Health services, information, or works protected by Irelia Health’s copyrights. Except as expressly permitted by Irelia Health, users may not reproduce, process, distribute, or create derivative works from Irelia Health’s copyrighted works.
     

  • Unless expressly authorized by Irelia Health, all rights to Irelia Health services, information, copyrighted works, trademarks, trade dress, or other assets and information provided through the Website are reserved by Irelia Health.

Changes to Terms of Use

  • Irelia Health may change these Terms of Use at any time by announcing them on the Application and Website. The changed provisions of these Terms of Use will be effective as of the date they are announced. Users must comply with any changes or corrections requested by Irelia Health promptly. If users fail to comply, any resulting damages, liabilities, and penalties are entirely the responsibility of the users.

Force Majeure

  • Force majeure events include, but are not limited to, natural disasters, riots, war, strikes, communication problems, infrastructure and internet failures, power outages, severe weather conditions, epidemics, or pandemics that are beyond the reasonable control of the affected party and cannot be prevented despite Irelia Health’s due diligence.
     

  • In the event of force majeure, Irelia Health is not liable for late performance or non-performance of any of the obligations under these Terms of Use or the Privacy Policy. Such situations will not be considered a delay, non-performance, or default, and Irelia Health will not be liable for any compensation.

Applicable Law and Jurisdiction

  • In the implementation and interpretation of these Terms and the management of legal relationships arising from these Terms, Turkish Law will apply, and the courts and enforcement offices of Istanbul will have jurisdiction.

Validity and Acceptance

  • These Terms of Use are effective as of the date they are published within the Website by Irelia Health. Users are deemed to have accepted these terms by using Irelia Health’s services and offerings.

Privacy and Security

  • This Website is the intellectual property of Irelia Health. Information on this Website may not be used, reproduced, transmitted, distributed, adapted, translated, or stored, in whole or in part, without the permission of Irelia Health.
